Welcome to Bookiyos, a website and service owned and operated by Medilogy INC (“Medilogy”, “we”, “us”, or “our”). By accessing or using Bookiyos (the "Site") or purchasing any products or services through the Site, you agree to the following Terms and Conditions. Please read them carefully before using the Bookiyos website, its mobile application, or any related services (collectively, the “Services”).

These Terms of Use constitute a legally binding agreement between you and Medilogy INC. If you do not agree with these Terms, please stop using the Site immediately. Medilogy reserves the right to modify these Terms at any time, and changes will be effective immediately upon posting on the Bookiyos Site.

We strive to provide accurate descriptions of the books, products, and services available on Bookiyos. However, we do not guarantee that all descriptions are error-free, complete, or current. If a product offered by Bookiyos does not match its description, your sole remedy is to return the product in unused condition.

3.2 Pricing and Availability

Prices for products are subject to change at any time without notice. Bookiyos may offer discounts or special promotions, which are subject to change or cancellation without prior notice. Prices listed on the website do not include taxes or shipping fees, which will be calculated at checkout.

While we strive to ensure product availability, Bookiyos does not guarantee that products listed as available will be in stock. If an item is out of stock, Bookiyos reserves the right to cancel your order.

3.3 Payment Terms

All payments must be made using one of the accepted payment methods displayed at checkout, including credit cards, debit cards, and digital payment services. By submitting payment information, you authorize Medilogy to charge the applicable payment method for the total amount due.

3.4 Order Acceptance

Orders placed on Bookiyos are not considered accepted until confirmed by Medilogy. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspicion of fraud, or product unavailability.

4. SHIPPING AND DELIVERY

4.1 Shipping Policy

Orders are generally processed and shipped within 1-2 business days of purchase. Shipping costs and delivery times are estimated at checkout based on your location and selected shipping method. Delivery times are estimates only and may be delayed due to unforeseen factors such as customs processing or carrier delays.

4.2 International Shipping

For orders placed outside of the United States, the customer is responsible for any additional customs duties, taxes, or other fees imposed by their country. Medilogy is not responsible for delays caused by customs inspections.

4.3 Risk of Loss

All items purchased from Bookiyos are shipped pursuant to a shipment contract. Title and risk of loss pass to you once the item is delivered to the carrier. Medilogy is not responsible for lost or damaged shipments after they have been handed to the carrier.

5. RETURNS, REFUNDS, AND EXCHANGES

5.1 Return Policy

You may return most items purchased on Bookiyos within 30 days of delivery, provided they are in their original condition and packaging. To initiate a return, contact Bookiyos customer service at info@bookiyos.com. You will be responsible for return shipping costs unless the return is due to an error by Bookiyos (e.g., wrong or defective items).

5.2 Refunds

Refunds will be processed within 5-7 business days after Bookiyos receives and inspects the returned item. Refunds will be issued to the original payment method used for the purchase.

5.3 Non-Returnable Items

6. USER-GENERATED CONTENT AND INTERACTIONS

6.1 User Content

You may submit reviews, comments, or other content to Bookiyos, provided that the content:

• Is not illegal, defamatory, or obscene.

• Does not infringe on any third-party intellectual property rights.

• Does not contain viruses or harmful software.

By submitting content, you grant Medilogy a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and distribute your content in any form, media, or technology.

6.2 Content Moderation

Medilogy reserves the right to remove or modify user content at its sole discretion. Medilogy does not actively monitor user-generated content but may review submissions if notified of violations of these Terms.

7. INTELLECTUAL PROPERTY

All content on the Bookiyos Site, including text, graphics, logos, images, software, and other materials, is the exclusive property of Medilogy INC or its content suppliers and is protected by international copyright, trademark, and intellectual property laws.

In no event will Medilogy’s total liability exceed the amount you paid for the product or service at issue.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

10.2 Arbitration Agreement

For any disputes arising out of or related to these Terms of Use, you and Medilogy agree to resolve such disputes through binding arbitration. This means that any dispute, claim, or controversy related to your use of Bookiyos will be resolved in a private forum, not in court. The Federal Arbitration Act and federal arbitration law apply to this agreement.

10.3 Arbitration Process

Arbitration will be conducted by the American Arbitration Association (AAA) under its rules. You and Medilogy agree that arbitration will take place in Sheridan, Wyoming, and both parties waive their right to a jury trial. You also agree to waive any right to participate in class action lawsuits or class-wide arbitration.

10.4 Exceptions

Certain claims, such as those for intellectual property infringement or claims falling within the jurisdiction of small claims court, are not subject to this arbitration agreement.

11. CLASS ACTION WAIVER

By agreeing to these Terms of Use, you agree to resolve disputes on an individual basis. You waive the right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding. All claims must be pursued on an individual basis.

12. SEVERABILITY

If any provision of these Terms of Use is found to be invalid or unenforceable by a court or arbitrator, such invalidity will not affect the enforceability of the remaining provisions. The rest of the Terms will remain in full force and effect.

13. TERMINATION OF USE

We reserve the right to terminate your access to Bookiyos or any part of the Bookiyos Services at our sole discretion, without notice, for any reason, including violation of these Terms. Upon termination, you are no longer authorized to use the Bookiyos Services.
